Bay County Jury Awards $200,000 For Florida Private Whistleblower Act Claim

Clark Partington trial lawyer Daniel Harrell had the privilege of representing a physician bringing claims against a medical practice that formerly employed her in 2020. Specifically, the physician asserted claims under the Florida Private Whistleblower Act.

After being recruited from Texas by the medical practice, Harrell’s client moved to Panama City to begin practicing with the medical group. Upon beginning practice with the group, however, she discovered that the group did not have appropriate documentation necessary to prescribe patients controlled substances and she refused to participate in this illegal practice. After eight and half days of employment and approximately 24 hours after her refusal, the medical practice terminated her employment citing patient care and professionalism concerns, which our client strongly disputed.

On June 6, 2024, at the end of a four-day trial, the jury returned a verdict in favor of Harrell’s client in less than 45 minutes. The jury found that the medical practice indeed retaliated against Harrell’s client by terminating her employment for refusing to engage in the illegal activity of prescribing controlled substances without documented medical necessity. The jury awarded Mr. Harrell’s client $200,000.00, and she is entitled to recover her attorney’s fees and costs.
